Terms of Service

1. Service Description

The BHI Community Membership is an educational platform providing professional development resources for hypnotherapy practitioners. The Service is offered in two tiers:

• Professional Membership ($97/month or $970/year): Access to public discussion forums, practitioner toolkit (intake forms, consent templates, session frameworks, business documents), summit replay recordings, peer messaging, monthly community events, priority directory placement, and full resource library.
• Inner Circle Membership ($197/month or $1,970/year): All Professional features plus monthly group consultation with Kelly, peer case consultation, quarterly NBCC-approved continuing education (CE) workshops, business office hours, featured directory placement, exclusive Inner Circle events, and priority support.

The Service is educational in nature. Nothing provided through this Service constitutes clinical supervision for licensure, psychotherapy, medical advice, or a substitute for professional mental health treatment.

2. Eligibility

You must be at least 18 years old to use this Service. By subscribing to any paid membership tier (Professional or Inner Circle), you represent and warrant that you meet the practitioner eligibility requirements described in Section 7 (Practitioner Attestation).

3. Subscription Terms & Auto-Renewal

Paid memberships are offered as automatically renewing subscriptions at the following tiers:

• Professional Monthly: $97.00 per month, billed automatically on the same date each month.
• Professional Annual: $970.00 per year, billed automatically on the anniversary of your subscription start date.
• Inner Circle Monthly: $197.00 per month, billed automatically on the same date each month.
• Inner Circle Annual: $1,970.00 per year, billed automatically on the anniversary of your subscription start date.

IMPORTANT: YOUR SUBSCRIPTION WILL AUTOMATICALLY RENEW at the end of each billing period at the then-current rate unless you cancel before the renewal date. You will be charged the applicable subscription fee using the payment method on file. You may cancel at any time as described in Section 4.

We reserve the right to change subscription pricing with 30 days' written notice. Price changes will take effect at the start of your next billing cycle following the notice period.

4. Cancellation & Refunds

You may cancel your paid membership (Professional or Inner Circle) at any time by:

• Accessing your account settings and selecting "Cancel Subscription," or
• Emailing info@boulderhypnotherapyinstitute.com with the subject line "Cancellation Request."

Upon cancellation:

• Your access to paid features continues through the end of your current billing period.
• Your membership access will end at the conclusion of the paid period.
• You will not be charged for subsequent billing periods.

Monthly Plans: No partial-month refunds are provided. Your cancellation takes effect at the end of the current monthly billing period.

Annual Plans: If you cancel within the first 30 days of your annual subscription, you are eligible for a pro-rated refund for the unused portion. After 30 days, no refunds are available, and your access continues through the end of the annual term.

5. Acceptable Use

By using the Service, you agree to:

• Use the community forums, messaging, and events respectfully and professionally.
• Refrain from sharing, distributing, or reproducing any BHI materials (scripts, templates, recordings, or other proprietary content) outside the platform without written permission.
• Not use the Service to solicit BHI members for competing programs or services.
• Comply with all applicable laws and professional ethical standards in your jurisdiction.
• Not post content that is defamatory, harassing, discriminatory, or that violates the privacy rights of others.
• Not misrepresent your credentials, training, or scope of practice.

We reserve the right to suspend or terminate your account for violation of these terms, with or without notice.

6. Intellectual Property

All content provided through the Service — including but not limited to scripts, templates, recordings, training materials, meditation content, and curriculum — is the exclusive intellectual property of Boulder Hypnotherapy Institute, LLC. Your membership grants you a personal, non-transferable, non-exclusive license to use these materials in your own professional practice.

You may NOT:

• Redistribute, resell, or share BHI materials with non-members.
• Use BHI materials to create derivative training programs or competing products.
• Record, transcribe, or redistribute group supervision sessions, CE workshops, or other live events without explicit written permission.

7. Practitioner Attestation & Resource Library Access

Paid members (Professional and Inner Circle) accessing the Resource Library represent and warrant that they have completed a hypnotherapy certification training program of at least 30 hours, or are currently enrolled in such a program. Scripts, templates, and clinical resources in the Resource Library are intended for use by trained practitioners only.

BHI provides these materials for educational purposes and assumes no liability for their application in clinical practice. Members agree to use all scripts and resources within their scope of practice and in compliance with applicable laws and professional ethics standards.

BHI reserves the right to request verification of training credentials and to restrict Resource Library access if practitioner status cannot be verified.

8. Educational Disclaimer

Boulder Hypnotherapy Institute, LLC is an educational institution. The BHI Community Membership, including all content, workshops, group supervision sessions, and resources, is educational in nature. Specifically:

• Group consultation is educational peer consultation and does NOT constitute clinical supervision for licensure purposes in any jurisdiction.
• CE workshops are approved by our NBCC-approved continuing education provider. Acceptance of CE credits is subject to each professional's licensing board requirements. Members are responsible for confirming CE eligibility with their own licensing board.
• Nothing in this Service should be construed as psychotherapy, medical advice, or a diagnosis or treatment of any condition.
• BHI does not guarantee any specific professional outcomes, income levels, or client results from participation in this membership.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOULDER HYPNOTHERAPY INSTITUTE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR YOUR MEMBERSHIP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

BHI is not liable for the actions, omissions, or professional conduct of any member. Members participate in group supervision, case consultation, and community interactions at their own professional discretion and risk.

10. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Massachusetts in accordance with the rules of the American Arbitration Association.

11. Modifications

We reserve the right to modify these Terms at any time. We will notify members of material changes via email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the modified Terms.
